The regulator that wants GPU futures just froze them

CFTC staff paused CME's first GPU rental futures until at least 9 November, while the agency's own notice says most GPU value trades in private deals.

9 Nov

New end of the CFTC review of CME's H100 and B200 rental futures. Planned launch was 5 Oct.

What changed

Lens read: the rule, the regulator, who pushed

The rule. Exchanges may only list contracts that are not readily susceptible to manipulation (Core Principle 3 of the Commodity Exchange Act). Staff used a 45-day extension power on 21 September.

Who pushed. CME and Silicon Data set the dates. ICE, Architect and others have rival designs. The CFTC chairman backs the market in public, and the notice leans on the July 2025 White House AI Action Plan. We found no lobbying disclosures or comment letters, so who argued what to the CFTC is a gap.

The economics. A hedge for GPU renters and GPU-backed lenders waits on one question: what price can a regulator accept as a benchmark?

readThe benchmark, not the exchange, is the bottleneck.

factChairman Michael Selig said America cannot win the AI race without a robust derivatives market for compute. The same agency's notice says compute price formation happens mostly in opaque bilateral deals, that non-public agreements carry most of the economic value, and that some price series use rates the providers post themselves. The stress point

One H100 hour, three trackers, three prices

contestedEach figure rests on one secondary report, and each measures something different: a neocloud-weighted index, a one-year contract rate, and a median of on-demand prices. They are not meant to match. That is the point: the CFTC notice says pricing varies dramatically across providers, regions and contract terms. The spread here is our arithmetic.

The shape

CoreWeave's debt grew about 22x in 30 months. Its backlog grew about 10x.

Four filing dates, not eight, so this is a sketch of direction, not a series. Backlog was $99.4B at March 2026. CoreWeave also said more than $25B of net new commitments arrived in early Q3, after this chart ends. Its own deck shows debt at 0.3x to 0.4x of backlog.

Source: CoreWeave 8-K investor deck, 2026. Multiples are our arithmetic (104.2 / 9.9 and 35.6 / 1.6). Debt is principal; the 10-Q shows $35.07B net of discounts.

The split

One dollar in five of CoreWeave's debt is due within 12 months

Of the $7.5B current portion, $6.2B is recourse and $1.3B is non-recourse. readThis is the kind of exposure a working GPU rental hedge would be built for, since lenders are exposed to what their collateral can earn. That is our reading, not a claim by CoreWeave or the CFTC.

Risks and the counter-case

The delay may be routine

factThe extension is a standard 45-day step, and the letter ties it to the open comment file, not to a finding against the contracts. Silicon Data's CEO has called the added review a natural part of building a new market.

Demand looks real

factCoreWeave's backlog is about 10x its end-2023 level. Three independent trackers show H100 rental prices rising over the past year. Hyperscaler 2026 capex plans total about $730B, per secondary trackers; we did not pull the 10-Qs.

Better indexes may pass

readICE, Architect and others plan different designs, such as power-normalised or multi-chip indexes. The CFTC is asking what would make a bilateral-market index acceptable. One of them may clear first.

What we do not know

We could not read the comment file, so we do not know what CME, ICE, lenders or providers told the CFTC. We do not know if CME has a new trade date; its product page says "later this year". A press report that the CFTC acted on manipulation risk is single-sourced, and the letter itself says only that the comment file is pending.

What to watch next

Sources and claims log

28 claims logged. 21 verified, 4 contested, 3 unverified and left off this page. Verified items rest on primary documents (the CFTC letter, the Federal Register notice, CFTC and CME releases, CoreWeave filings) except the direction of H100 prices, hyperscaler capex totals and the existence of rival exchange plans, which rest on secondary sources.

Contested here: the three H100 price levels, each from one secondary report, and the press account of why the CFTC extended its review.

Could not find: lobbying disclosures and comment letters; hyperscaler 10-Q capex lines; a primary GPU price series with eight or more points; filings for neoclouds other than CoreWeave; a new CME trade date.
